Overview of the Services

Playtester provides a platform that allows users to discover, follow, and participate in game playtests across various platforms. Playtester does not develop, publish, or operate the games listed on the platform unless explicitly stated.

Eligibility

You must be at least 13 years old to use the Services. By using Playtester, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have your parent or legal guardian’s permission to use the Services.

Account registration and security

You may create an account using an email address or by authenticating through third-party providers such as Discord or Steam. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized access or security breach

We are not responsible for losses caused by unauthorized access resulting from your failure to safeguard your account.

Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using Playtester, you acknowledge that you have read and understood the Privacy Policy.

Acceptable use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Interfere with or disrupt the security or operation of the Services
• Upload or distribute malicious code, spam, or automated scraping
• Post content that is unlawful, abusive, defamatory, or infringes on the rights of others
• Attempt to gain unauthorized access to any part of the Services
• Use the Services to build, train, or support products or services that directly compete with Playtester, without our prior written consent

We reserve the right to investigate and take appropriate action for violations of this section, including suspending or terminating your access.

User content

You may submit content such as comments, feedback, or other materials (“User Content”). By submitting User Content, you:

• Retain ownership: You retain all rights to your User Content.
• Grant us a license: You grant Playtester a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, and display such content solely for operating, improving, and promoting the Services.
• Represent accuracy: You represent that you have the necessary rights to submit the User Content and that it does not violate any laws or third-party rights.

Third-party services and links

The Services may contain links to third-party websites or services, including game stores and external platforms. Playtester does not control and is not responsible for the content, policies, or practices of third-party services. Your interactions with third parties are solely between you and them.

Intellectual property

Except for User Content submitted by users, the Services and all related content, features, and functionality are owned by Playtester and protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, or create derivative works based on our Services without our prior written consent.

Suspension and termination

You may stop using the Services or request account deletion at any time by contacting us at contact@playtester.io.

We may suspend or terminate your access to the Services, with or without notice, if:

• You violate these Terms
• Your use poses a risk to the platform, users, or third parties
• We are required to do so by law

Upon termination, your right to use the Services will immediately cease. We may delete your User Content within a reasonable period following termination, unless we are required to retain it for legal compliance.

Service availability and changes

We may modify, suspend, or discontinue any part of the Services at any time, temporarily or permanently, with or without notice. We will provide reasonable notice for significant changes that materially affect your use of the Services. We are not liable for any modification, suspension, or discontinuation of the Services.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Playtester disclaims all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Services will be uninterrupted, secure, or error-free
• That any content or information will be accurate or reliable

Limitation of liability

To the maximum extent permitted by law, Playtester shall not be liable for:

• Indirect damages: Any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.
• Total liability cap: In no event shall our total liability exceed the amount you paid to Playtester in the twelve (12) months preceding the claim, or USD $100, whichever is greater.

Some jurisdictions do not allow the limitation of certain damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Playtester from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

• Your use of the Services
• Your violation of these Terms
• Your User Content
• Your violation of any rights of a third party

Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for significant changes, we may notify you via email or through a notice on our platform. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

General provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations to any affiliate, subsidiary, or successor in interest.

Entire agreement

These Terms constitute the entire agreement between you and Playtester regarding the Services and supersede any prior agreements.
